Our products and services provide instant access to health and fitness data so you can track your progress, push your goals and take control of your health. As we build these tools, we are committed to the principles of respecting your privacy, keeping your data safe, and letting you decide how your information is used and shared. This is our Privacy pledge:

 

  • 1. We will only collect data that is useful to improving TupeloLife products, services and your experience.

POLICY

TupeloLife respects the privacy of the visitors to the Site. This TupeloLife Privacy Policy (the “Privacy Policy”) is intended to inform you of our policies and practices regarding the collection, use and disclosure of any personal information.

Personal information we collect on our websites and in our applications are sent to our servers and may be processed by us.

Information we collect – Our Site

We collect the following information you provide to us on our site: Your first and last name, email address, addresses, password if you create an mymolife account, and payment information if you purchase a product on our site.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Do third parties see and/or have access to information obtained by the Application?

 

Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  1. 1. As required by law, such as to comply with a subpoena, or similar legal process;

  2. 2. When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  3. 3. With our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

  4. 4. If TupeloLife is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

 

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at privacy@tupelolife.com.

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us atprivacy@tupelolife.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at privacy@tupelolife.com. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or text message. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. You can check the history of this policy by clicking here.

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.

TUPELOLIFE PRIVACY POLICY

TupeloLife designs products and tools that track everyday health and fitness to empower and inspire users to lead healthier, more active lives. This privacy policy applies to our personal fitness and electronic body monitoring products (“Devices”), our websites located at www.tupelolife.com, www.tupelolife.com/in (individually a “Site” and collectively “Sites”), the TupeloLife Gateway (“Software”) and TupeloLife mobile applications for iPhone OS and Android OS (each an “App” and together the “Apps”). The Devices, Sites, Software and Apps are collectively referred to in this privacy policy as the “TupeloLife Service”.

Because we’re always looking for new and innovative ways to help you achieve your fitness goals, this policy may change over time. If any modifications substantially change your rights under this policy, we will send you an email where possible, and always provide notice on the Site.

What Data Does TupeloLife mymo Collect?

When You Activate a TupeloLife device

When activating a TupeloLife device like mymo, you will be asked to download the TupeloLife App or install Software and enter information about yourself, such as height, weight and gender. We use this information to determine your personalized fitness stats– for example, calories burned and distance traveled. Depending upon the specific Device you use, it can collect the number of steps you take, your weight and transmit this data to TupeloLife Servers.

What information does the Application obtain and how is it used?

User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us. When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application, and; (e) information you enter into our system when using the Application, such as contact information and project management information. We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

When You Add Information to Your Account

You can customize your TupeloLife experience by adding other types of information to your account, such as by adding a food log or by setting an alarm, personalizing your profile with photos, participating in mymowall, or sending messages to your mymolife friends. Whenever you add this type of data, we collect it and store it with your other account information.

When You Sync Your Device

When you sync your device, data about your activity is transferred from your device to our servers. This data is stored and used to provide the TupeloLife Service. Each time a sync occurs, we also log data about the transmission. Some examples of the log data are the sync time and date, device battery level, and the userid used when syncing. All the device id is encrypted for security reasons.

When You Add Friends

To help you stay motivated on your fitness journey, TupeloLife lets you add friends who are already tupeloLife users or invite friends who have not yet joined. You can add friends in several ways, such as by providing their email addresses, by accessing social networking accounts such as Facebook, or from the contact list on your phone. When you share your friends’ contact information with us to add them as a friend, we will only use it for this purpose. We do not store your phone’s contact list, and it is deleted immediately after it is used for this purpose.

How We Use Your Data

TupeloLife uses your data to provide you with the best experience possible, to help you make the most of your fitness, and to improve and protect TupeloLife. Here are some examples:

  • 1. Height, weight, gender and age is used to estimate the number of calories you burn.

  • 2. Contact information is used to send you account notifications, allow other TupeloLife mymolife users to add you as a friend, and to inform you about new features or products we think you would be interested in.

  • 3. Your data is used for research to understand and improve TupeloLife products and services.

  • 4. Logs and other data are used to troubleshoot TupeloLife services; detect and protect against error, fraud or other criminal activity; and enforce the TupeloLife Terms of Use.

  • 5. De-identified data that does not identify you may be used to inform the health community about trends; for marketing and promotional use; or for sale to interested audiences or Insurane providers

  • 6. We use your data to troubleshoot the TupeloLife Service, enforce the TupeloLife Terms of Use, and/or detect and protect against error, fraud or other criminal activity.

 

How Long We Save Your Data

We store your data for as long as you remain a TupeloLife or mymolife customer.

How To Edit or Modify Data

Any data that you provide to TupeloLife through the Site or app can be modified from your dashboard or preferences. If you remove data from your User Account, it will no longer appear to you or others who use the Service. Backups of that data will remain in association with your User Account and in our archive servers.

Community and Social Media Posts

To post to TupeloLife mymolife community message boards, you can use TupeloLife services by connecting through social media like facebook and twitter. This community username will be posted next to any comments you publish on community message boards. Other information, like a profile photo that you’ve added to your Tupelo account may also be visible on message boards, depending on your Tupelo mymolife account settings. Tupelo also reserves the right to delete any abusive content from the social wall.

Data Analytics

When You Activate a TupeloLife device

We use Google Analytics that allow us to see how you use our services so we can improve your experience. We encourage you to read the Google Privacy Policy. If you prefer to not have data reported by Google Analytics, you can install the Google Analytics Opt-out Browser Add- on. We use analytics to make our services better and offer you with the best services possible.

Third Party

What Data May be Shared With Third Parties?

First and foremost: We don’t sell any data that could identify you. We only share data about you when it is necessary to provide our services, when the data is de-identified and aggregated, or when you direct us to share it.

Data That Could Identify You

Personally Identifiable Information (PII) is data that includes a personal identifier like your name, email or address, or data that could reasonably be linked back to you. We will only share PII data under the following circumstances:

With companies that are contractually engaged in providing us with services like order fulfillment, email management and credit card processing. These companies are obligated by contract to safeguard any PII they receive from us. If we believe, after due consideration, that doing so is reasonably necessary to comply with a law, regulation, or valid legal process. If we are going to release your data, we will do our best to provide you with notice in advance by email, unless we are prohibited by a court order from doing so or where the request or legal process is directly related to a regulatory investigation. In the latter case, we will ensure user information we disclosed is treated as confidential. If we believe, after an investigation that is reasonable given the circumstances, that doing so is necessary to prevent imminent and serious bodily harm to a person, address fraud, maintain the security of the TupeloLife Service and user data, protect our rights or property or the rights or property of a third party, or to enforce our Terms of Service. If it is necessary in connection with the sale, merger, bankruptcy, sale of assets or reorganization of our company, your PII can be sold or transferred as part of that transaction as permitted by law. The promises in this Privacy Policy will apply to your data as transferred to the new entity.
